Terms and Conditions

BATHWICK CAR AND VAN HIRE LTD TERMS AND CONDITIONS

Driving Licence

Drivers must be between 25 and 75 years of age and able to produce a full, valid, British driving licence held for at least two years. Our reservations agent must be informed of any endorsements on the driver's licence, as we may not be able to take your booking. No refunds will be given for rentals rejected due to non-production of a driving licence or non-disclosed endorsements. For more details contact the DVLA in Swansea on 0870 240 0009, faxed or photocopied licences are not acceptable.

Identification

All UK residents must be able to produce two recent utility bill’s or bank statement’s dated within the last 3 months and a valid credit or debit card in the names of the hirers. International hirers must be able to produce a passport and valid credit card in the name of the main hirer.

All additional drivers must be present at the time of hiring and must be able to produce a full valid driving licence conforming to the stipulations above. All drivers must produce the online share code from DVLA (Please refer to driving licence changes) (Ni number).

Travel outside of the UK

We do offer cover for customers to take vehicles outside of Mainland Britain at an additional cost, however due to Insurance restrictions a minimum age of 30 is required for drivers in vehicles travelling outside this area. Please contact us for further details** If you would like more information or a quote for driving our vehicles abroad then please contact us on +44 (0) 1249 461267. **Please be aware that until approved by Bathwick Car and Van Hire, no vehicles can be taken outside of mainland Britain**

Excluded costs

Personal accident insurance. Fuel is paid locally. Additional driver requirements should be notified and paid for at the time of booking. Delivery and collection of your car can be arranged, but there may be subject to an additional cost. Also excluded are out of hour's charges, optional extras such as child seats (which must be requested at the time of booking)

Occupations

There are restrictions imposed by our insurer, which mean that we are unfortunately unable to hire to persons in certain occupational areas. These include professional entertainers, professional sports persons, publicans, nightclub owners, owners of gaming establishments, members of the foreign military and students.

Insurance and Collision Damage Waiver
Insurance is included in the cost of the hire subject to an Excess agreed onsite at the time of rental. Collision Damage Waiver offers the hirer peace of mind in the event of loss or damage to the hire vehicle by reducing the hirer’s Excess liability. E.g. the standard excess may be £1000 and payment of a daily charge (CDW) may reduce the excess to £500.
Collision Damage Waiver (CDW) is not usually included in the cost of the hire, but can be purchased to reduce the hirer’s excess to a minimum - usually no lower than £300, Collision Damage Waiver may not be available on all vehicle.

Insurance Excess.
In the event of an at fault accident, the hirer shall be liable to pay the amount specified below:
The insurance excess is £1000 for most vehicles. This excess is not taken in the form of a deposit, we will simply take a credit card imprint and ask that you are responsible for any repair charges, in the unlikely event of an accident, we may charge your card for the appropriate amount.

Provision of Vehicles

Please note that we can refuse to provide a vehicle to any customer who is, in our opinion, unfit to drive or does not meet eligibility requirements. In such circumstances your contract with us will terminate immediately, and Bathwick car and van hire will have no further liability to you.

Number of passengers

Our rental vehicles are insured for a maximum number of passengers. Bathwick Car and Van Hire cannot accept responsibility if the vehicle is not large enough to fit all passengers and luggage on arrival if details were not supplied at the time of booking.

Car type / suitability

Bathwick Car and Van Hire is unable to guarantee a particular make or model of car. The car shown on your voucher is for guidance only and may be substituted for an alternative, similar or upgraded car (at no extra cost). If you are dissatisfied in any way with the standard of the car, you must advise us immediately in writing within 30 days of your return. The Company cannot accept liability where this procedure is not followed. Bathwick Car and Van Hire are constantly updating our fleet, therefore we may hold two different models of the same vehicle including an older shape if the manufacturer has recently updated the look of the vehicle. Bathwick Car and Van Hire is unable to guarantee which shape of vehicle you will receive. We are also unable to guarantee the type of fuel your vehicle will use ahead of time.

Mechanical difficulties

In the event of any mechanical difficulties, it is important that details are reported to us within 24 hours. Failure to do so may delay the investigation of disputes regarding insurance excess charges.

Congestion charging

Any vehicle movement into, out of or within the marked charging zone ("CCZ") between 07:00hrs and 18:30hrs (Monday to Friday), is chargeable at the rate of £8 per day. Only one payment per vehicle, per day is required, once the first payment is made, any number of journeys may be made that day into, out of or within the CCZ, by that vehicle. The payment of £8 must be made by 22:00hrs on the day the movement was made; otherwise the charge rises to £10. If that is not paid before midnight, a Penalty Charge Notice will be issued in the sum of £120 (discounted to £60 if paid within 14 days). If the charge is not paid within 28 days, the charge rises to £150. Further details may be obtained from Transport for London's website: www.cclondon.com.

Your Responsibilities

You must pay for any vehicle movement into, out of or within the CCZ, Where we make a delivery to you, within the CCZ; you must pay the £8. This covers the first day's Charge. All other days' charges, including the charge for the last day of the hire, are your responsibility. When you pay the charge, you will be given a receipt / transaction number for the payment. Please retain this number as you will need it in case of a dispute between you and Transport for London ("TfL") You can pay by phone, text, Internet, or pay - point, but you must pay on the day you used the CCZ. If you fail to pay, TfL will send you a Penalty Charge Notice. It is your responsibility to pay this Penalty Charge. If you fail to pay the charge on the day you used the CCZ, you will also be charged an Administration Fee by us.

Mini Bus Hire

Due to insurance restrictions we are unable to supply Mini busses to anyone with a licence issued outside of the UK. All drivers must be over 30 years old. If you did not pass your driving test before January 1997 your licence must show the D1 category. All licences must be clear of any endorsements, if you are unsure about any of the above then please contact our call centre on +44 (0) 1249 461267.
Our Mini busses can be taken outside mainland Britain.

Pricing fluctuations
Rental Charges are subject to change without prior notice. All reservations received prior to a pricing change will obviously be honoured at their original rate.

Complaints

If you have a problem during you rental, please inform us immediately so that we can endeavour to put things right. Bathwick Car and Van Hire will not hold themselves responsible for the non-performance of anything that is beyond their control or when they are not notified of a problem at the point when remedial action can be taken. In the unlikely event that a complaint cannot be resolved at the time, you should write to our Customer Services Department within 30 days of the issue arising. You can call +44 (0) 1249 461267. If you fail to take any of these steps this will hinder our ability to put any problem right and/or investigate it fully and any right you may have to receive compensation will be reduced or completely invalidated.

Additional Services

Additional Drivers are charged at £40 per driver per week or £10 per day for hires of less than 7 days. This is capped at 2 weeks and any further weeks additional driver cover is free. If you require additional drivers, they must be present at the time of hiring and are subject to the same restrictions as the main driver. Charges for additional drivers are payable locally on arrival.

 

Accidents/Damage.
The renter is responsible for all damage, however so caused, during the hire period. Vehicle repairs and chargeable maintenance will be charge at cost plus 20%. The renter is responsible for any damage to the roof or upper part of the vehicle caused by hitting low objects, such as bridges or branches. This applies irrespective of whether or not renter has opted for CDW
The renter is responsible for any damage to the vehicle includes glass and tyres damage, water and flood damage. The renter will have to pay for repairs if the vehicle needs more than a standard valet or if the vehicle has been damaged either inside or outside (whether or not its renters fault). You must complete an accident form as soon as it is possible to do so. Full details of third parties should also be obtained if applicable. A check in sheet must be signed when the vehicle is returned. Failure to follow this process may delay the investigation of any disputes regarding repair charges. The renter must not let anyone repair the vehicle without our permission. If any work is required on the vehicle, the renter must notify us immediately and return it to us for any work to be completed. If you choose to return the vehicle outside of office hours, you remain responsible for the vehicle until the vehicle can be checked by a member of staff. The renter is liable for any charges incurred up until this time. We reserve the right to charge for any loss of rental income, due to the vehicle being in for repair.

Fully Inclusive rates

Unless specifically amended elsewhere in this agreement, Bathwick Car and van hire rental rates are fully inclusive of unlimited mileage, fully comprehensive insurance and VAT.

Payment/Deposits

All payments must be made by a credit, switch or debit card.
Deposits may be required to secure your booking.
We do not accept cash or cheque payments.

Cancellations / Amendments

All cancellations must be submitted by calling +44 1249 461267 prior to the date of collection. Bathwick Car and Van Hire will not refund any unused rental days.

Deliveries

Delivery and collection requires a minimum of 3 days’ notice - Full address including postal code and a contact number are required. Delivery and collection times are not confirmed at the time of booking, only AM or PM. You must contact the branch to confirm times at least 24 hours prior to the start date. The driver must be present to check and sign for vehicle.

Fuel Policy

All vehicles are provided on a Like for Like basis. We provide the vehicle with an amount of fuel requesting that you return the vehicle with the same amount. Failure to do this will result in a charge being levied per 1/8th tank. E.G. Hiring a car with a full tank and returning with 7/8ths will result in a charge for 1/8th tank. This means that we will not ask for a fuel deposit when the vehicle is collected. (We do not refund over fuelling.) All refuelling is costed at pump price.

Traffic Offences

An Administration Charge of £30 + VAT will be levied per offence plus the excess Parking Charge (where necessary), Any Penalty Charges for Speeding/Road traffic Offences (Including Bus Lane Offences & London Congestion Charges) And any other Traffic Infringement charges.

Renters Responsibilities
The renter is responsible for the vehicle and key and has a duty of care to maintain the vehicle whilst on hire to them and must, by law, be kept in a road worthy condition. The vehicle must be kept locked and any security device fitted to the vehicle must be used when the vehicle is not being used. All engine fluids must be checked before use and topped up if required. Lights, wipers and tyre condition should also be checked prior to use and replaced if not in a road worthy condition (like for like)
The vehicle must be returned to the location agreed by the rental office. If you choose to return the vehicle outside of office hours, you remain responsible for the vehicle until the vehicle can be checked by a member of staff. The renter is liable for any charges incurred up to this time.

Ending this agreement
We will end this agreement if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may end this agreement if you do not meet its main conditions.
If you are a company, we will end this agreement if:
You go into liquidation
you call a meeting of creditors
we find out that your goods have been taken away from you until you pay off your debts; or
you do not meet any of the conditions of this agreement.
If we end this agreement it will not affect our right to receive any amount you owe us under the conditions of this agreement. We can also claim reasonable costs from you if you do not meet the main conditions of this agreement. We can repossess the vehicle and charge you a reasonable amount for doing so.

General conditions

All bookings by our clients are subject to our terms and conditions as detailed on the Rental Agreement. No other terms, conditions and warranties, expressed or implied by law, custom and course of dealing shall form part of any contract between Bathwick Car and Van Hire and our clients except for those terms implied by law whose application is mandatory. The client acknowledges that in making a booking with us it does so only on the basis of the material contained in this document. All other statements or representations made by us, its employees, or agents are of no effect unless confirmed by us to the client in writing. You should satisfy yourself that you understand and agree to its terms and conditions as you will be subject to, and must comply with these terms. Bathwick Car and Van hire reserves the right to levy any government increase in VAT that may be introduced after the production of this document. liability to the client for any loss, damage, injury or accident whatsoever, whether arising out of negligence, breach of contract or any other cause shall not exceed £2000 or twice the invoiced price of rental of the vehicle concerned (whichever is greater) provided that nothing in this clause shall limit Bathwick car and van hire ltd liability for death or personal injury caused by its negligence. This does not affect your statutory rights as a consumer. Bathwick car and van hire will not be held responsible for anyone driving under the influence of alcohol/drugs, causing wilful damage, off road driving or driving without due care and attention. The client will indemnify Bathwick Car and Van Hire ltd against this in respect of such claims this list is not exclusive.
